Our heart goes out the the LGBT community in Virginia. The Governor went ahead and removed the LGBT community from existing statewide anti-discrimination protections.

It's one thing for a homophobic conservative to refuse to implement non-discrimination statutes for the LGBT community. But it's quite another to remove existing non-discrimination statutes, which is exactly what recently-elected Republican Governor Bob McDonnell of Virginia has done.

I got this from Basic Rights Oregon.

You can find info on it by visiting their web site.

Be well

Erica.

From: The New Civil Rights Movement
In his response to President Obama, McDonnell stated,

Quote:
"All Americans should have the opportunity to find and keep meaningful work, and the dignity that comes with it.

"Many of us here, and many of you watching, have family or friends who have lost their jobs.

"1 in 10 American workers is unemployed. That is unacceptable.

"Here in Virginia we have faced our highest unemployment rate in more than 25 years, and bringing new jobs and more opportunities to our citizens is the top priority of my administration."

I wonder if he was thinking at that time of excluding gays from the equation?

Ummm NO.

The new governor did no such thing. Previous governors (both democrats) had signed executive orders giving STATE EMPLOYEES such protections, not the general public. The new executive order effectively rescinds the previous executive orders.

It's easy to jump the gun on things like this. Executive orders are NOT laws, they only cover government employees. It is to be expected that executive orders will go back and forth depending on the party in office.

Thanks for clarifying, Leah... it sounded a bit weird when I read the OP (I didn't think the governor had authority to rescind established law).

Two weeks ago, if you were LGBTQ and worked for the State of Virginia, you knew you could not be discriminated against for being gay.

Misleading.

In theory, you could not be discriminated against for being Gay. But you could for being Trans. They weren't covered.

And the courts said that as there was no legislation to back it up, the Executive Order couldn't be enforced:
Quote:
The Circuit Court for the City of Martinsville has ruled in Michael Ware Moore v. Virginia Museum of Natural History that Executive Order 1 (2006) signed by Virginia Governor (and DNC Chair) Tim Kaine provides no cause of action to gay Virginians fired for discrimination based on sexual orientation, nor does it waive the Commonwealth of Virginia's defense of sovereign immunity against fired gay employees seeking redress.
It didn't amount to a hill of beans.

The only problem with the new Executive Order is that it will positively encourage such discrimination in future.
